| Resumo: | Este trabalho apresenta uma análise sobre a atuação da Assembleia Legislativa do Amapá (ALAP) na promulgação de leis sobre a cidadania feminina e identifica os tipos de direitos que estão sendo garantidos para as mulheres, tendo como referência as demandas dos movimentos sociais de mulheres no Amapá. Tem como objetivos específicos identificar as leis que versam sobre os direitos das mulheres, no conjunto de leis aprovadas de 1992 até 2016 e construir uma tipologia para estas leis. Optamos assim pela hermenêutica como método e a análise de documentos como técnica de pesquisa. O texto está dividido em três capítulos: O primeiro capítulo tratará sobre a construção da cidadania que temos hoje, através de um apanhado histórico. O segundo capítulo apresenta a constituição dos direitos humanos em sua concepção na Organização das Nações Unidas – ONU, e os momentos que foram cruciais para tal feito no Brasil e no mundo. O terceiro capítulo está dividido em duas partes: 1. Análise das leis promulgadas que versam sobre mulheres de 1992 até 2016, que foram classificadas em quatro tipos de acordo com a análise da ementa da lei; 2. Discussão sobre a agenda de demandas dos movimentos sociais de mulheres no Amapá, afim de que possamos compreender a atuação da ALAP e a percepção dos movimentos sociais para a cidadania feminina. Através da categorização que realizamos sobre as leis promulgadas para mulheres, compreendemos que a atuação da ALAP (quando analisada na perspectiva da sociedade amapaense), é ineficaz. Concluímos assim que às mulheres não é garantido um efetivo exercício da cidadania, pois existe uma gama de direitos que não estão legislados e, os que estão, não são cumpridos e tornam-se ineficazes para a cidadania, pois não contemplam demandas essenciais da sociedade. |
| Abstract: | This paper presents an analysis of the work of the Legislative Assembly of Amapá (ALAP) in the enactment of laws on female citizenship. It also identifies the types of rights that are being guaranteed for women, based on the demands of the social movements of women in Amapá. Its objectives are to identify laws that deal with women’s rights in the set of laws passed from 1992 to 2016 and to construct a typology for these laws. We thus chose hermeneutics as a method, and the analysis of documents as a research technique. The text is divided into three chapters: The first chapter will deal with the construction of citizenship that we have today, through a historical survey. The second chapter presents the constitution of human rights in its conception in the United Nations - UN, and the moments that were crucial for this done in Brazil and in the world. The third chapter is divided into two parts: 1. Analysis of enacted laws that deal with women from 1992 to 2016, which were classified into four types according to the analysis of the law; 2. Discussion on the agenda of demands of women's social movements in Amapá, so that we can understand the ALAP's performance and the perception of social movements for female citizenship. Through our categorization of laws enacted for women, we understand that ALAP's performance (when viewed from the perspective of the society of Amapá) is ineffective. We conclude that women are not guaranteed an effective exercise of citizenship, because there is a range of rights that are not legislated and those that are, are not fulfilled and become ineffective for citizenship, because they do not contemplate essential demands of society. |
