O paradigma da autoidentificação: um estudo de caso sobre Vila Brasil no Parque Nacional Montanhas do Tumucumaque

Abstract

The scientific technical report is based on the analysis of a judgment issued in case no. 0000004-53.2015.4.01.3102, which is being processed at the 1st Federal Court of Oiapoque, filed by ICMbio against the Oiapoque County, claiming that the Municipal Law that makes the village of Vila Brasil district, and aims to investigate the importance of evaluating the self-identification criterion for identity recognition, one of the requirements raised in the judgment, and what are the theoretical and foundations presented. What the Judiciary has as its function to “say what it’s right” before judicial conflicts, and to develop its role is to use an interdisciplinarity as a tool for the improvement of such themes, in the case of Vila Brasil, or the automatic identification test seeks attention for new directions of social sciences, which specifies anthropological knowledge, which argues that it does not recognize generates cultural silencing and understanding that only subjects can automatically identify themselves as members of some ethnic group. Thus, it is intended to understand the judgment of the first degree of the judiciary on ethnic groups and ethnic identity. Focusing on the judicial process involving the Vila Brasil community, in addition to the field diary collected through the participant observation and documents also collected during the trip, a research follows a strand of legal sociology as it must analyze a complex procedural act, the sentence, comparing its foundations with the relevant social and legal relations. Opting to use a participant observation field survey because it understands that the contact with the community is necessary to confirm or not a documentary prediction. The report did not seek to define the identity of Vila Brasil residents, but concluded that the fact of automatic identification was not used in the judgment to define as district or not and understood the importance of recognizing cultural diversity to generate collective self-esteem of mainly group empowerment.
