Análise da eficiência, eficácia e efetividade da atuação do batalhão ambiental no sistema de fiscalização ambiental do Estado do Amapá

Abstract

This study aimed to demonstrate the contribution and importance of the performance of the Environmental Battalion in environmental enforcement activity conducted in the state of Amapá in order to confirm the effectiveness of this activity or not and, if the results achieved are effective and efficient under Administrative tutelage. For this, it was necessary to make an approach to concepts of environmental law, such as the analysis of the main means of defense and the environment, civil and criminal Environmental Administrative Ministry, as well as the concepts of efficiency, efficacy and effectiveness to analyze the performance and understanding necessary to understand the results presented. The methodological procedures were based on a survey of documentary data for analysis and assessments of administrative procedures completed; and questionnaire to officers composing the effective Environmental Battalion; the period of data analysis was the year 2012. It is noteworthy that a comparative study of the performance of BA and IMAP this period was performed. The results confirmed the initial hypothesis that the actions of the Environmental Battalion is efficient because it performs optimally and with the resources available through the end of the activity and achieving significant results concerning the number of assessments carried out in one year, but produces inefficient results, regarding the continuation of the assessments, which depends exclusively on the competence of the trial IMAP administrative procedures; and finally not an effective performance, due to the results achieved with the trial of cases. Being that this is due to the scarce investment in environmental agencies and environmental monitoring activity performed in the State of Amapá, both in infrastructure and logistics as training and ongoing training to perform the activity. But we realized that the existence of Military Police Organization (OPM) is of utmost importance for the Environmental Surveillance System of the State along with the IMAP because directly assists the prosecutor in defending the legal environment as well, in addition to ensuring support agencies federal, as ICMBIO, originating in the protection of natural resources of the Protected Areas of the State of Amapá, and other bodies related to environmental protection
