A força dos tratados internacionais no ordenamento jurídico brasileiro: o caso dos tratados de proibição de armas nucleares

Abstract

This article discusses the importance of international nuclear treaties in Brazilian domestic law and its implications for the implementation of national economic development and defense policies. The current international situation is marked by the existence of nuclear artifacts harmful to peace and international security. In order to contain such a threat and to avoid catastrophes similar to the warlike attacks in Hiroshima and Nagasaki, after 1945 a process of construction of a nuclear non-proliferation regime began, characterized by the existence of several normative instruments in this thematic area. The Nuclear Non-Proliferation Treaty represents a historic mark in terms of banning the development and complete elimination of still existing nuclear weapons. Brazil adopts a foreign policy that is active in promoting nuclear disarmament and defending its use only for peaceful purposes. This objective is present in its Constitution and influences the creation of important initiatives internally, such as the creation of a nuclear submarine, the stimulus to the construction of thermonuclear energy sources and the development of a multipurpose reactor. In this way, this research analyzes these projects in light of the nuclear objectives present in these important international treaties.
