Defensoria Pública: o acesso à justiça em seus aspectos estruturais, econômicas e políticos na Fronteira Franco-Brasileira

Abstract

The main objective of this work is to show that access to justice in the Franco-Brazilian border is fundamental for the population that seeks their rights through the judicial process. We have this right based on art. 5, item LXXIV of the Federal Constitution of 1988, in which it is affirmed that the State will provide full and free legal assistance to those who prove insufficient resources. In this area, the Public Defender's Office plays a fundamental role in the implementation of this constitutional right, guaranteeing the hypocrites the protection of their fundamental rights. We evaluate the proposed theme with a foundation in the Major Law, the Federal Constitution of 1988, works by Mauro Cappelletti and Bryant Garth, Complementary Laws nº 1,060 / 1050 of Legal Assistance, Complementary Law nº 80/1994, and Complementary Law nº 86 of July 25 of 2014 (rule that regulates DEFENAP in the State of Amapá). The scope of this study is the Public Defender's Office, in what concerns the understanding of legal assistance in the State of Amapá, specifically the city of Oiapoque - located on the border of Brazil with French Guiana, and its role as a primary service to support society. It also contains the concept of access to justice, the application of the principle of the dignity of the human person, by compressing the obstacles found in the legal system of the country. It is urgent to analyze the deficiency of access to free justice, in its structural form and its multiple political and economic aspects in the Brazilian border, in the accomplishment of this access through this public institution. Finally, this work collaborated to show the picture of the current situation of effective free access to justice in the municipality of Oiapoque, and its applicability, which in general influences the essential guarantees of the most vulnerable population, especially when we observe the existence of the main demands in the city and Public Defenders
